These general course terms and conditions of the Music Association Alauda Dulcis, registered in the association register under ZVR number 195583774, apply to all music courses, workshops, seminars, events and other offerings organized by the Music Association Alauda Dulcis, hereinafter always referred to as “offerings.” By submitting a registration, the participant expressly agrees to these conditions. Even for offerings of the Music Association Alauda Dulcis without registration, the participant expressly agrees to these conditions by participating.
You can register in person, by email or via the website. Persons aged 14 and above are entitled to register. Written registration is required for all fee-based offerings. Information about this can be found on the website and in the current printed materials. Each registration always constitutes a binding offer. Upon registration, each registrant is obligated to provide the following information: first and last name, address, date of birth, telephone number. Any changes to the provided information must be reported to the Music Association within five days at the latest.
After acceptance of the offer by the Music Association and thus conclusion of a contractual relationship, the participant fee must be paid to the association’s account, referencing the offering and the participant, after receiving the issued invoice and at the latest five working days before the offering begins. After this time, the Music Association reserves the right to assign the place to someone else. A participant’s later entry does not entitle them to a reduction of the fee. Payment of the fee in two installments is permitted for annual offerings, however an additional surcharge of €10 per semester is charged for installment payment. The first installment must be transferred to the Music Association’s account no later than 5 working days before the offering begins, the second installment for annual offerings no later than January 31st of the current season. For later entry into annual offerings, a prorated fee is charged from November 3rd onwards; before this date, the full price must be paid. For shorter offering formats, calculation is prorated. Please refer to our current price list on the website www.alaudadulcis.com for current prices.
Cancellation of an offer that has already been booked and confirmed by the club is possible in writing up to one week before the start of the offer at the latest. The entire fee must then be paid, regardless of whether the participant actually attends the offer or not. For distance bookings (via the music association’s website or by email), participants as consumers within the meaning of Section 11 Paragraph 1 FAGG have a statutory right of withdrawal within a period of 14 days, valid from the day the contract is concluded, whereby sending the Declaration of withdrawal within the deadline is sufficient. You can find a sample cancellation form for the declaration of withdrawal on our website. However, this right of withdrawal does not apply if the offer begins and is completed within these 14 days as agreed and the consumer has provided confirmation of knowledge of the loss of the right of withdrawal. If you book an annual offer, you can also cancel your registration during the first half of the season, until January 31st at the latest, for valid reasons on the part of the participants, such as illness, relocation and the like. The participant is obliged to provide written proof of the valid reason. If the aforementioned requirements are met, 50% of the contribution for the annual offer will be refunded to the participant. Alternatively, a one-off, free rebooking can be made to another offer organized by the music association, provided there is space available. If a participant cancels registration in the second half of the season, there will be no refund. It is expressly pointed out that for all other offers (except annual offers) there will be no full or partial refund of the contribution under any circumstances – unless the withdrawal takes place in accordance with Section 11 Paragraph 1 FAGG. In the event that an offer organized by the Alauda Dulcis music association has to be canceled in its entirety for whatever reason, the participation fee or the aliquot part will be refunded. The change of the offer and the change of an artist/offer manager do not authorize participants to withdraw from the contract. A change in the location of the offer, provided the change of location is reasonable for the participant, or the transfer to remote courses on selected platforms (via telephony, video telephony, online communication tools, email & distribution/provision of video and audio recordings, etc .) berealso does not constitute grounds for resignation.
The length of an offering can be found on the website and printed materials of the Music Association Alauda Dulcis for all participants and interested parties. Units cancelled due to the artist/offering leader’s unavailability will be made up when possible. Units not attended by the participant will not be made up. No offerings generally take place during autumn holidays, Christmas holidays, semester holidays, Easter holidays, Whitsun holidays, on school-free days and occasionally on bridge days. You will be expressly informed of exceptions when booking. If an offering takes place in a school facility, the respective school’s autonomous free days also apply as offering-free days. Each participant confirms having taken note of the offering calendar.
The Music Association Alauda Dulcis reserves the right to cancel offerings where a specified minimum number of participants is required if this number is not reached. In this case, the already paid fee will be fully refunded. The Music Association Alauda Dulcis also expressly reserves the right to switch offerings from in-person to remote mode and back as needed, after prior information. Remote offerings (via telephony, video telephony, online communication tools, email & distribution/provision of video and audio recordings, etc.) are considered equivalent substitute services to in-person offerings. The participant is responsible for the necessary prerequisites (technical or organizational nature). Offering places are only transferable to third parties with prior consent of the Music Association. Textbooks and scripts are not included in the participant fee unless expressly described otherwise in the offering program.
The Music Association Alauda Dulcis values creating a constructive, relaxed and entertaining learning atmosphere. Our goal is to create an environment where students feel comfortable and are excited to play their instrument when they are ready. However, if a participant repeatedly refuses to participate in lessons or does not want to play during lessons, we will communicate with the parents/guardians twice after the first incidents to clarify the situation. If there is no improvement and it happens a third time, the participant will be withdrawn from our school and receive a full refund from the day of withdrawal. With this policy, we want to ensure that we appreciate our students’ commitment and respect the waiting list of eager learners who are ready to engage and benefit from the education we offer.
The Music Association Alauda Dulcis is not liable for damages unless they were caused intentionally or through gross negligence by it or its agents. Liability for personal injury remains unaffected. Similarly unaffected remains liability for damages from violation of contractual main obligations. Any liability for third-party and consequential damages, as well as for lost profits, is excluded. Furthermore, the Music Association assumes no liability for damage to or loss of personal items of participants, unless the Music Association can be charged with intent or gross negligence. Participants are liable for damages they cause to the association’s property (including but not limited to the Music Association’s inventory and equipment) as well as to the premises required for holding the offerings.
In the course of registration for our offerings, we process personal data. Through registration, the student or their legal representative consents to data collection and processing according to the privacy policy. Photo or video recordings taken during music courses, workshops, events and lessons may be used by the Music Association for advertising purposes under granted anonymity. It is possible to withdraw this consent by email here.
